Body-Up EMS Training

1. Scope

These Terms and Conditions (hereinafter the "Terms") apply to all services provided by Body-Up EMS Training located at Route des Tattes d'Oie 95, 1260 Nyon, Switzerland ("Body-Up"), in particular group EMS training sessions, trial sessions, single sessions and memberships.

By booking a session, purchasing a service or using the website body-up-ems.ch, the client accepts these Terms without reservation.

2. Services Provided

Body-Up mainly offers:
  • Free trial group EMS sessions
  • Group EMS sessions purchased individually (single sessions)
  • Group EMS memberships with a duration of 1 month, 3 months, 6 months or 12 months

Details of the offers, durations, schedules, prices and promotions are shown on the website or in Body-Up's communication and may be changed at any time.

3. Registration, Booking and Client Account

  • Bookings are made via the booking system (for example Sportsnow), via the website, by phone or directly at the studio.
  • Body-Up may require the creation of a client account with correct and up-to-date information.
  • Body-Up reserves the right to refuse a booking or access to a session for legitimate reasons.

4. Health Status, Questionnaire and Client Responsibility

Electro Muscular Stimulation (EMS) is a specific training method that has contraindications (for example: pacemaker, certain heart diseases, pregnancy, acute infections, etc.).

  • Before starting training, the client must complete a health questionnaire and answer fully and truthfully.
  • The client undertakes to inform Body-Up of any significant change in their health condition before the session concerned.
  • In case of doubt, Body-Up may require a medical certificate.
  • The client remains solely responsible for checking with their doctor whether EMS is appropriate for them.

5. Prices, Payment and Refunds

  • Prices are indicated in Swiss francs (CHF), VAT included where applicable.
  • Memberships must be paid in advance.
  • Single sessions are paid before or at the time of the session.
  • The trial group EMS session is free (generally one free trial per person).

Accepted means of payment: Cash, TWINT, Bank transfer, Online payment via Stripe.

Refunds: As a general rule, no refunds are granted once the service has been paid for, unless otherwise required by law.

6. Cancellation, Rescheduling and No-Shows

  • Any cancellation or change must be made at least 24 hours in advance.
  • Late cancellation (less than 24 hours) or no-show: the session is deducted and cannot be rescheduled.
  • Exception: upon presentation of a medical certificate, Body-Up may offer a postponement.
  • If the client is late, the session still ends at the scheduled time.

7. Duration, Validity and Freezing of Memberships

  • Body-Up offers memberships with durations of 1 month, 3 months, 6 months or 12 months.
  • There is no automatic renewal: at the end of the chosen duration, the membership ends.
  • A membership may be frozen only upon presentation of a medical certificate.

8. Hygiene, Safety and Behaviour

The client undertakes to:
  • Comply with hygiene rules (clean training clothes, respect for the premises)
  • Follow the trainer's instructions during the session
  • Use the equipment carefully and appropriately

Body-Up reserves the right to immediately exclude, without refund, any person who behaves inappropriately.

9. Liability of Body-Up

Body-Up and its trainers provide their services with due care.

To the extent permitted by Swiss law:
  • Body-Up excludes any liability for indirect or consequential damage.
  • Body-Up is not liable for injuries resulting from non-compliance with instructions or undeclared health conditions.

10. Intellectual Property

The content of the website body-up-ems.ch (texts, images, videos, logos) is protected by copyright. Any reproduction that has not been expressly authorised is strictly prohibited.

11. Data Protection

The processing of clients' personal data is governed by Body-Up EMS Training's Privacy Policy, available on the website.

12. Governing Law and Jurisdiction

These Terms are governed by Swiss law.

The exclusive place of jurisdiction for any dispute is Nyon (VD), Switzerland.
